Thank you for choosing Breathe4School (“we”, “our”, “us”). We value our Institutions, Teachers, Parents,Students, Guardians and Tutors and this Refund & Cancellation Policy (“Policy”) has been designed to ensure transparency in how payments, cancellations, and refunds are handled.

This Policy forms part of and must be read together with our Sales Agreement, Terms & Conditions, and Privacy Policy.

  1. Scope and Application

1.1 This Policy applies to all payments made by Institutions (schools, colleges, training centres, etc.), and by users (teachers, parents, students,guardians and tutors) through the Breathe4School Platform.
1.2 By subscribing to or making any payment for our services, you acknowledge and agree to this Policy.

  1. General Rule : Non-Refundable Fees

2.1 All subscription fees, setup charges, service costs, and license payments are strictly non-refundable once a subscription is activated or services are delivered, unless specifically covered under Section 3 (Refund Eligibility).
2.2 Institutions and Users are encouraged to review demo versions, product literature, or trial access (if provided) before making a purchase.

  1. Refund Eligibility

Refunds will only be considered in the following limited circumstances:

  • Duplicate Payment: If the same payment is charged more than once due to a system or gateway error.
  • Wrong Amount Charged: If you are billed an incorrect amount that is higher than the agreed subscription fee due to a verified system error.
  • Service Non-Activation: If you made a successful payment, but access to the subscribed LMS services was not activated within a reasonable time frame due to a technical issue solely attributable to Breathe4School.

Note: All such claims must be verifiable through system logs, payment receipts, and internal checks by our support team.

  1. Non-Refundable Cases

Refunds will not be provided in the following situations:

  • Change of Mind: You no longer wish to use the service after purchase.
  • Incomplete Usage: Services were purchased but only partially used (e.g., some classes, modules, or features not accessed).
  • Technical Issues on User Side: Inability to access services due to device/browser incompatibility, poor internet connection, power outages, force majeure or user error.
  • Subscription Expiry: Paid access expired without full utilization of the services.
  • Violation of Terms & Conditions: Services suspended or terminated due to misuse, breach of policy, or unlawful activity.
  1. Cancellation Policy

5.1 Subscriptions are time-bound (monthly, quarterly, annual, as per the agreed plan).
5.2 A cancellation request will stop auto-renewal of your subscription at the end of the current billing cycle.
5.3 Cancellation does not entitle you to a pro-rata or mid-term refund. The subscription will remain active until the end of the paid period.
5.4 For Institutions under contractual Sales Agreements, cancellation terms will follow the specific contract provisions agreed upon separately.

  1. Refund Request Process

6.1 To request a refund under eligible cases (Section 3), you must submit a written request within 7 calendar days of the transaction.
6.2 Requests must be sent to sales@breathe4school.comwith the following details:

  • Name of Institution/User
  • Transaction reference number and invoice
  • Date and amount of payment
  • Reason for refund request, with supporting documents/screenshots

6.3 Refund claims without sufficient details or made beyond the 7-day period will not be entertained.
6.4 The Company reserves the right to verify claims with internal records and third-party payment providers before approving/refusing a refund.

  1. Processing of Refunds

7.1 Once approved, refunds will be processed to the original method of payment within 15–21 business days.
7.2 Processing times may vary depending on the bank, card issuer, or payment gateway. We are not responsible for delays once the refund is initiated from our side.
7.3 Refund amounts will exclude any payment gateway or transaction charges imposed by third-party providers.

  1. Chargebacks and Payment Disputes

8.1 If you initiate a chargeback or payment dispute directly with your bank or card issuer without first contacting us, we reserve the right to suspend your account until the matter is resolved.
8.2 False or fraudulent disputes will be treated as a violation of our Terms & Conditions and may result in termination of access and legal action.

  1. Amendments

We may update or revise this Policy from time to time to reflect changes in business practices or legal requirements. Updated versions will be published on our website with the revised Effective Date. Continued use of services after updates constitutes acceptance of the revised Policy.

  1. Institutional Bulk Purchases

In cases where Institutions purchase bulk subscriptions (for multiple students/teachers):

  • Refund requests must be raised only by the authorized representative of the Institution.
  • Individual student/parent refund requests will not be entertained directly by Breathe4School, unless agreed otherwise in writing.
  1. Customization & Setup Charges
  • Any fees paid for setup, customization, training, or integration are strictly non-refundable, even if the subscription is later cancelled or terminated.
  1. Data Retention After Cancellation

Following cancellation or termination:

  • Access to services will cease immediately after the paid period.
  • User/Institution data may be retained for 30 days to allow export/download.
  • After this period, we may securely delete data, except where legally required to retain it.
  1. Right to Refuse Refunds
  • Breathe4School reserves the right to reject any refund request that appears to be abusive, fraudulent, or made in bad faith.
